For the period of January 14-17, the Verkhovna Rada adopted 11 Laws and 1 Resolution

( Information Department of the Verkhovna Rada of Ukraine Secretariat )

Such Laws were adopted in entirety:

“On amendments to the Law of Ukraine “On eliminating negative consequences, preventing prosecution and punishing people in connection with events taking place during peaceful assemblies”

The Law stipulates: free from responsibility, in a manner and in terms defined by this law, persons who are suspects or accused (defendants) of committing crimes during the period of November 21 – January 26, 2013 including crimes stipulated by articles 109, 122, 161, 171, 185, 194, 259, 279, 289, 293, 294, 295, 296, 341, 342, 343, 345, 348, 349, 365, 376, 382, 386 of the Criminal Code of Ukraine, provided that these crimes are connected with mass protest actions that started on November 21, 2013, and close respective criminal proceedings;       

free persons convicted of committing crimes stipulated by article 1 of this Law from punishment in a form of imprisonment for a certain period of time and from other punishments not connected with imprisonment in a manner and in terms defined by this Law;    

close criminal proceedings that were opened in connection with crimes stipulated by article 1 of this Law and in which no persons were informed about the suspicion. 

Respective bill was registered under No. 3893.

 

“On amendments to article 197 of the Tax Code of Ukraine re VAT exemption of importing natural gas into the customs territory of Ukraine”

The Law renews the norm of the Tax Code, according to which, operations of importing natural gas into the customs territory of Ukraine are exempt from VAT in accordance with the code of Classification of Goods for Foreign Economic Activity (UKT ZED) 2711 21 00 00.  

Respective bill was registered under No. 3853-1.

 

“On amendments to the Law of Ukraine “On free legal assistance” (re postponement of coming into force the provisions of clause 6 of chapter VI “Final and Transitional Provisions”)

The legislative act postpones coming into force the provisions of the Law “On free legal assistance” till January 1, 2015.

Respective bill was registered under No. 3792.

 

“On amendments to the Criminal Code of Ukraine re responsibility for denial and excuse of fascist crimes”

The legislative act supplements the Criminal Code of Ukraine with a new article 436-1 “Public denial or excuse of fascist crimes, propaganda of neo-nazi ideology, production and (or) distribution of material excusing crimes of fascists and their supporters.”     

Respective bill was registered under No. 2179а.

 

“On amendments to the Rules of Procedure of the Verkhovna Rada of Ukraine”

The Law amends articles 218-221 of the Rules of Procedure of the Verkhovna Rada and improves procedure of giving consent for bringing to responsibility, detention or arrest of the people’s deputy of Ukraine.  

Respective bill was registered under No. 3883.

 

“On amendments to article 297 of the Criminal Code of Ukraine (re responsibility for desecration or destruction of monuments erected in commemoration of those who fought against fascists during the Great Patriotic War – the Soviet military men-liberators, participants of the partisan movement, undergrounders, victims of fascist persecutions and peacekeepers)”

The Law amends article 297 of the Criminal Code of Ukraine and establishes that “Desecration of a grave or other burial place, as well as abuse of corpse (remains, ashes) of the deceased, desecration of the urn containing the ashes of the deceased, or illegal seizure of corpse (remains, ashes) of the deceased, of an urn containing ashes of the deceased or objects that are in the grave or any other burial place, or on the corpse (remains, ashes) of the deceased, - 

shall be punished with a fine in the amount of up to two hundred citizens’ personal exemptions or with a sentence up to six months, or custodial restraint of up to three years or imprisonment for the equal period.”

It is also established that “Desecration of a mass grave or the Tomb of the Unknown Soldier, or a monument erected in commemoration of those who fought against fascists during the Great Patriotic War – the Soviet military men-liberators, participants of the partisan movement, undergrounders, victims of fascist persecutions and peacekeepers, -

shall be punished with custodial restraint from three to five years or imprisonment for the equal period.”

The respective bill was registered under No. 2178а.

 

“On amendments to the Criminal Procedure Code of Ukraine (re criminal proceedings in absentia)”

The legislative act establishes grounds and procedure of conducting criminal proceedings in absentia.  

The document stipulates that a person upon whom the criminal proceeding in absentia is conducted has the right to arrive for direct participation in the criminal proceeding in any time. 

In order not to violate rights and freedoms of the suspect or accused, the Law stipulates that during conduction of the criminal proceeding in absentia participation of the defender is mandatory.

The Law stipulates that if the person proves their absence during the proceeding on the basis of valid excuses or could not inform about reasons of absence on the basis of valid excuses, it will be an undoubted reason for reversal of judgment adopted following the results of the criminal proceeding in absentia.    

According to the Law, the suspect or accused, except form a simplified procedure of appeal against the judgment adopted following the results of the criminal proceeding in absentia, is guaranteed to have the right to appeal against such decision on appeal.   

Amendments were made to the Criminal procedure Code of Ukraine.

Respective bill was registered under No. 3587.

 

“On amendments to several legislative acts of Ukraine re liability for administrative offences of the sphere of road safety, recorded automatically”

The legislative act introduces automatic photo and video recording of the following offences:

exceed of speed limits;

driving on a red traffic control signal;

violation of the ban established for transport vehicles as to driving on pavements or pedestrian precincts;

driving on the wrong side of the road;

violation of the railway crossing rules.

The respective bill was registered under No. 3855.

 

“On amendments to the Law of Ukraine “On the Judicial System and Status of Judges” and procedural laws re additional protective measures of citizens’ safety”

The Law stipulates enhance protective measures regarding some categories of persons and objects, increase sanctions for some criminal and administrative infringements, as well as establish additional enforcement actions for maintenance of public order, rights and legitimate interest of citizens.

Respective bill was registered under No. 3879.

 

“On amendments to several legislative acts of Ukraine (re responsibility for commitment of administrative offences during football matches)”

The legislative act strengthens responsibility of fans for violation of public order during football matches.

The Law amends and supplements the Code of Ukraine on Administrative Infringements and the Law “On the Peculiarities of Ensuring Public Safety and Peace in Connection with Preparation and Holding of Football Matches”.

The respective bill was registered under No. 3837.

 

“On the State Budget of Ukraine for 2014”

Under the Law, the revenue of the State Budget for 2014 totals UAH 392.404.327,7 thousand which includes the revenue of the general fund of the State Budget in the amount of UAH 347.515.815 thousand and the revenue of the special fund of the State Budget in the amount of UAH 44.888.512,7 thousand, according to Appendix No. 1 to this Law.

The Law fixes the expenditures of the State Budget for 2014 in the total of UAH 447.294.687,9 thousand which includes the expenditures of the general fund of the State Budget in the amount of UAH 401.113.217 thousand and the expenditures of the special fund of the State Budget in the amount of UAH 46.181.470,9 thousand.

The Law also envisages the following:

repayment of loans to the State Budget of Ukraine for 2014 in the total of UAH 4.390.745,1 thousand, including repayment of loans to the general fund of the State Budget of Ukraine in the total of UAH 1.410.091,2 thousand, and repayment of loans to the special fund of the State Budget of Ukraine in the total of UAH 2.980.653,9 thousand;

issue of loans from the State Budget of Ukraine for 2014 in the total of UAH 9.047.619,9 thousand, including issue of loans from the general fund of the State Budget of Ukraine in the total of UAH 1.361.341,5 thousand, and issue of loans from the special fund of the State Budget of Ukraine in the total of UAH 7.686.278,4 thousand;

the limit deficit of the State Budget of Ukraine for 2014 in the total of UAH 59.547.235 thousand, including the limit deficit of the general fund of the State Budget of Ukraine in the total of UAH 53.548.652,3 thousand, and the limit deficit of the special fund of the State Budget of Ukraine in the total of UAH  5.998.582,7 thousand, according to Appendix No. 2 to this Law.

The respective bill that was adopted with consideration of the opinion of the Budgetary Committee was registered under No. 3000.

 

The Resolution ““On establishment of the Temporary Inquiry Commission of the Verkhovna Rada of Ukraine on investigation of wrongful acts on the part of law-enforcers and separate officials and encroachment on the rights and freedoms, as well as life and health of citizens in the course of the events connected with mass actions of socio-political protest that took place in Ukraine on November 21, 2013”

Under the Resolution, the main tasks of the Temporary Inquiry Commission are as follows: obtain complete and accurate information concerning wrongful acts on the part of law-enforcers and separate officials connected with mass actions of socio-political protest that took place in Ukraine on November 21, 2013; identify specific persons guilty of organizing forceful dispersal of peaceful demonstrations, beating of people, attacks on journalists and hindering of their professional activity; as well as preparation and referral of the respective materials to the Prosecutor Generals’ Office of Ukraine in order to bring to responsibility the abovementioned persons. 

The people’s deputy Hennadii Moskal (faction of the All-Ukrainian Union Batkivshchyna) was elected the head of the Temporary Interim Commission.

The term of tenure of the Temporary Interim Commission was set to be one year starting from the day of adoption of this Resolution.

There shall be granted a hearing to the report of the Temporary Inquiry Commission during the plenary meeting of the Verkhovna Rada of Ukraine not later than six months after the Resolution was adopted.

The Resolution comes into force on the day of its adoption.

The Resolution was adopted with consideration of specifications.

The respective draft resolution was registered under No. 3832.
